As opposed to paying $200 extra for an early upgrade, I think I made out well. Also, I have seen completely destroyed iPhones selling on eBay for over $100. So after I get the 3G, I can list the old one & at the very least, hope to get my money back.

But you also have to remember, people are trying to find loopholes, such as the one you are trying. That said, people are trying to buy iPhones for $100 before the new phone comes out to avoid paying the additional $200. So right now there is a much higher demand for the iPhone than there will be after the iPhone 3G comes out.

If that's true, then I say it was good to get away with paying only 50 bucks then. win/win situation either way you look at it.

I would be absolutely sure that you will become eligible by doing this. Many people are reporting success with their online accounts showing them as being eligible, but when I activated my old, pre-paid iPhone with my sim I had just got after getting a free blackjack, my account did not change to upgrade eligible. I talked to AT&T and they said I would need to return the blackjack to become eligible (which I did, and now I am).
It's possible AT&T is being very leniant here, but something tells me people are going to be singing a different song on launch day when AT&T tells them that their account was not eligible and that the iPhone they activated did not help that situation.
