So can you upgrade with one line, get home change sim cards and cancell the data plan...?

AT&T's return policy has changed effective 10/07/12. You have 14 days to return the device & cxl without a ETF. Policy info HERE.
Where is Justin Timberlake when you need him?. I need him to billed me a bridge to get a cross all these tears from complainers.This post is protected under the laws of the United States & other Countries. I talked to an ATT Rep. today, and they said that yes, I would be able to "sell my iPhone to someone else", and they would simply be able to put their SIM card in and go.
She also said that you would have to transfer the IMEI over, so I'm not sure what that entails.

I don't know if this is the same thing...but my mom was eligible for an upgrade and I wasn't, so I originally put the iPhone on her line and AT&T switched it over to my line. Her contract was still extended, but in the end I got the phone.
And your line was not put in under a new contract right?

NO, to avoid the fees, you must cancel within the first 30 days and return the phone. If you cancel after the first 30 days you owe the ETF. Also, Best Buy has their own contract with you and there might be other fees from them. Finally, if you cancel after the first 3 days but before 30 days are up, you still owe the activation fee.
The guy at Best Buy wanted the sale at your expense.

It starts at $175 and starts to go down $5/mo after two months. Best Buy and other non-corporate sellers may have their own fees on top of what ATT charges.
