if i had an iphone 3gs but was on a no data plan with a "dumbphone" and was in the middle of a 2 year contract, what would i take to use the iphone. and if so could i use it with no data charge

You can switch your SIM card from the old phone to the iPhone 3GS. Then call AT&T, have them update your IMEI in their system, and select a data plan. Data plans are required to use a smartphone on AT&T.

There is no cost to switch phones and no changes to the contract. The only additional cost is the required data plan.
