Torch Consistant ly crashing

I was annoyed when the ATT service center told me I had to have a Torch when my 9700 had died (of course that was no necessarily a prize it was my 4th one [1st: key fell out; 2nd died in Hong Kong; 3rd died in NY; 4th Died again in NY -- not dropped just rebooted and froze).
Anyway, now I have this Torch which seems to need to be reset 2-3 times a day. It's a refurb. I am not surfing and OMG-ing all day, I use it for email.
The pros are clearly its a very pretty screen and my 2yr old love watching crap on it and OS6 is pretty, but the rest of it is crash prone, short battery.
The OEM charging doc is hilariously large and the phone does not reorient the phone list when it's sitting sideways in the doc.
Do I have a lemon? I am patiently waiting for the 9900. Anyone with similar experiences? Any solutions besides throwing it against the wall?

My Torch is a total piece of crap... Must re-boot anywhere from 3 to 10 times a day, a daily thing for past week and a half! I got in touch with BB Customer service after the guy at the ATT store checked it out and said "something is not right with this phone". He kindly gave me a receipt from computer with my info on it and assistance from BB so I called. The lady was to send me a list(via email) of what to try as I do childcare and did not have time for it, thought taking battery out probaby 100 times was enough trouble. Then she was to call me back at 8 pm(at my request) to assure it was okay. Well she called not long after 6pm, really??? Just got done babysitting and she was calling at her convenience! To top it off NEVER did get the instructional email list from her. I called back this morning as I missed the call at 6, which I knew I would. She was really filled with attitude and trying to get me to go through the same thing, told her NO time! She wouldnt email to me, said she couldn't do that. I said well the other girl said she was...Anyway, no more BB for me, Verizon is looking better each day the passes. They want your money and I have internet and 3 lines and about ready to carry it all back to the local store and walk away from lousy service, unprofessional phone personnel who look at us only as a number.

I can't stand my torch. It's by far the worst phone, or ANYTHING i've ever purchased.
It is PAINFULLY slow. Slow response time with the touch screen and when I tilt the phone from horizontal to vertical views. My first one actually completely stopped working one day and I had to send it back to ATT. It was an ORDEAL. They made me do a whole troubleshooting thing (none of the keys worked!) and "upgrade the OS." It did absolutely nothing. It took them a week to send me a new phone. A WEEK. I told them I do not want the same phone, as it is a giant piece of garbage, and they ASSURED me that it was a different phone and it had upgrades.
Lo and behold, I received the same exact phone with the same exact OS and the same exact problems. My new phone is slow, crashes a million times a day, I have to remove the battery to restart it. It's really an inconvenience.
And I'm just getting started...
I don't get service in my own house... 8/10 calls get dropped. The ones that don't are staticy and barely audible.
ATT customer service is bad, bordering on nonexistant. Good luck getting any help in the stores! Those people are literally NO HELP. I want to cancel my service SO BAD but I have 2 lines and it'd cost me a whopping $700 to cancel. I don't have that kind of money. I feel like I'm being bullied!
I'm paying so much money to use a phone that barely works on a service that barely works. I am so frustrated and unhappy and I can't believe that I'm paying a company to make me feel this way.
