I assume that you are not on the unlimited talk, text and data plan. So smartphone data can be eliminated.

Next, firmware upgrade fail can also be eliminated since you have the factory installed one.

Will you check if data was accidentally turned off?

Look at the top of the screen. A 3G icon with up and down arrow indicates that there's 3G data.

Is your data included with unlimited text and talk?
Is your phone a US phone?
