Upgrade Question.. .

So, I've been into At&t at least three times within the last several months, with absolutely no luck and no help; just disappointment.
Last February (2011) I got the HTC Inspire. Well, if you know or have heard of anyone with the phone, you've probably heard nothing but complaints since HTC sent out the software update that made the phone crash. I'm still all for HTC phones (strongly considering going for the One X), so despite them not standing behind their flawed product, they still have a loyal customer. AT&T however, has done absolutely nothing to provide me with any solutions. My phone is now to the point where it crashes or freezes daily and I have to pull the battery out completely, and restart the phone (which literally takes five minutes to turn it back on). As of last night, the volume button has fallen off completely. It glitches constantly and is becoming unusable. My phone is apparently not eligible for an upgrade until October, but I cannot wait that long. I've tried the GoPhone route, with no success, and I can't afford to pay the $700+ out-of-contract price for a new phone. Both HTC and AT&T need to stand behind their products. Is there anything that can be done, short of shelling out the $700 for a new phone out of contract?
I'm ready to take my business elsewhere. In this day and age, it's nearly impossible to function without a working phone, especially when I have to have it for work and school.

I would be going after HTC. They made it and they should be the ones to provide support for it. Other than warrenty exchange, ATT does not provide actual hardware support that I am aware of.

HTC has moved on to the One X, and apparently considers the Inspire to be a lost cause. I'm not counting on any upgrades or software fixes for the phone itself; I'm looking for options for getting a new phone entirely. How to go about that, what fees there are, what my options are, etc.
There has to be some option other than the out-of-contract price, or a GoPhone. I'm not sure if Early Termination is a possibility, or what.

You pretty much hit them all on the head. That is why I would go after HTC. Make them upgrade your phone to a working model.

Since my phone is contracted through AT&T, I don't see how HTC can send me a different phone model or upgrade my current phone. Based upon other forums both on this site, and the HTC Support site, the most they've done is send replacement phones (same model), with the same issues.

I am in the same boat. Got 2 Inspires in 2/11 and the both freeze up 2 or 3 times a week.
One line came due for upgrade this month and the second line shows October.
I called last week and got the Retention Dept. to upgrade the second line now.
I told them that I want 2 Galaxy S 3's. They said no problem, but the Retention Dept. will not have them avail. until 7/13.
I can wait a few more days.

To clarify, your service is contracted through AT&T, not the phone. Since your phone is over a year old, I doubt that either company would help you. Insurance could be an option if you have it, but I won't get into all of the possible scenarios there, as I am not personally familiar with Asurion's services.
Have you considered purchasing a phone through a third party like Amazon, Ebay or Craiglist? Do you have a friend/relative/neighbor that has a back-up phone that you can use?

You have an other option, an early upgrade. It's a 2 year contract price (and a 2 year contract + $36 upgrade fee) of $199 plus $250 for upgrading early, so $450 total (plus an upgrade fee). I truly do not understand your logic though, you admit that HTC make lousy phones and provides no support, yet you insist on remaining loyal to them but blame AT&T for not letting you upgrade early... because HTC made a bad phone... and won't stand behind their product... but AT&T should somehow be responsible for it... I just don't get it man. Seriously though, buy a Samsung Galaxy S3 or Motorola Atrix HD, both better phones.

I thought that the early upgrade was only available to iPhone owners when upgrading to another iPhone. I never had the early upgrade option for other phones when I had an iPhone and now that I don't, I don't have any early upgrade options.

You hear more about it with the iphone since so many people want to upgrade each year vs every 18 to 24 months.

When I had an iPhone, from day one I had the early upgrade option for other iPhones. All other phones were offered at the no-commitment price until the day of my full upgrade. I upgraded to a Nokia Lumia. When I log in now, all phones (including iPhones) are only available at the no-commitment price.

It seems the wait for for early upgrade is about 15 months now

I would definetely be contacting HTC. The retailer (whether it be AT&T or another store like Best Buy or some Cell Phone Shack in the mall) is responsible for the phone for the first 30 days. The manufacturer (HTC) is responsible for the phone for a year via their warranty. AT&T or the retailer can help fascilitate the warranty repair process with you. If you have some sort of extended warranty or insurance plan, you may want to go that route.

Either that or do a "factory" reset on your phone but make sure you back up anything important... That worked on my Blackberry when I funky update came out...

I had the same problem with my HTC and after many calls I got the info that chrisjbritt posted above and got a replacement phone from HTC...it worked great!
