Hello all,
I am planning to upgrading my line to an iPhone 4S. Since I would be signing a contract for a new iPhone 4S that requiring data plan, voice, and messaging plan, are there any loop holes in this contract? Basically, I would be still using a regular phone, canceling out the data plan because i'm not using the smart phone, and only be paying for voice, texting. Would this be violating the agreement that I would have to sign for the iPhone 4S? the iPhone 4S would be still be kept unused as a collection.

When you renew a contract, you are agreeing to keep a voice plan for the two years. Now if you get the iPhone in a store, they will probably activate it there so you may not end up with an unopened iPhone?

yes I plan to renew my contract agreeing to keep the voice plan for another 2 years. I do also want the iPhone 4S at the discounted price for $200.00 + 36.00 fee but wish to not to activate it or do anything that will prevent me to having an data plan. if so, if I do contact customer care and then have the data plan removed because i'm using my sim card on a reglar phone, would this be violating my contract

so the contract agreement that I sign for my iPhone 4S would be only for voice and why does it say with data plan included? if I never use the iPhone 4S that I pay for at a discounted price, I don't pay for data plan right? after, i'd be just using a regular phone. can i do this??

are you competely sure about this?
can you guide me to your source through the contract terms where it would say the plan im signing for is for only voice plan? I don't want to find out that im being automatically charged for data plan and then cancel it and later then i get charged for a early termination fee for what i done.
besides that... the contract that i signing for an iphone 4S, am i locked in for voice + data or only voice??

I cannot find the terms but you are only required to carry a voice plan. Search here for others who have lost their iPhones and downgraded to a standard phone to eliminate the data plan since it is an expensive phone to carry. Search for posts from users who find the data plan to expensive and recomended that they go to a standard phone.
Unless you get your phone from a third party that may require your keep that data plan, a Voice plan is what your contract is for when purchased from Apple or ATT.

I cannot explain. All I know if that if you use a smartphone on their network, you must have a data plan. If you use a standard phone you only need a voice plan. Why you need an unopened iPhone is a different question?
Your contract is for voice, data if you USE as smartphone not OWN one.
If you are so concerned about the data part of the plan, go to Apple and buy an iPhone at full price that does not require a contract nor an activation at the time of purchase.

i would be using the iPhone but without any voice/data/messaging features. It would be used as an itouch basically.
I am concerned about the data part of the plan but i wouldn't go to apple and buy an iPhone at full price that doesn't require a contract nor an activation because i am eligible for the upgrade if you know what i mean?
with an iPhone 4S and if I do plan on using data, I would just use an go-phone

As has been stated, contract is for the VOICE plan only. Data is a feature that can be added and/or removed (if you're not using a smartphone) as you like.
However, IF you bought the phone through some other source than AT&T they might have their own terms on the contract that says you have to keep your plan the same with no changes for 6 months (or so) or pay the full amount of the phone.

Can anyone explain why someone in my house hold who currently owns a iPhone 4S and under a new contract tells me that the contract they sign is with a voice and data plan?
And also show me a source in the contract that everyone signs for an iPhone 4S that says its only for voice only?
