My Battery Backup Unit has died. After working with Belkin, they determined that it was out of warranty. AT&T won't replace it, they tell me I have to buy it. My position is that it's part of the service I pay for monthly. Very disappointing.

I have had U-verse since mid May 2012 and noted that AT&T wording is ambiguous when discussing the battery backup.
The Belkin UPS (uninterruptible power supply) contains a battery and AT&T says it is the customer's responsibility to replace the battery when it no longer functions. AT&T predicts a 4 year life for the battery.
The ambiguity is that sometimes the term "battery backup" refers to the entire Belkin UPS unit and sometimes it refers to the internal battery.

My understanding is that AT&T provides one (1) UPS with battery at time of Uverse Voice install. After any applicable warranty period, it becomes the customer's responsibility.

The $40 battery is no longer availalbe from Belkin. When you call they want to sell you the complete unit for $130

How can this be when the FCC mandated all VOIP are provided with a battery backup for emergencies. Its a required part of the service according to federal law or can someone clear up the mandate for me and others reading this and please cite your sources.

I cannot find any source for your "FCC mandated" or "required...according to federal law." I see a proposal by the California state Public Utilities Commission to require an 8 hour BBU lifetime, but that apparently didn't make it into the regulation book.
I think it may be time for you to cite your source.

It's a 12V, 7.2 AH (amp hour) gell cell.
They are available from a few thousand places (Google), including Radio Shack..
Prices range from $25 to $35
It is my understanding that they will also dispose / recycle the old battery in a responsable fashion.
