I already have two phones on my plan and one phone is crap so I'm deciding to order a free phone online and replace it with the crappy phone but at&t is trying to make me set up a whole new plan with the free phone and they won't let me do otherwise
unliess that line is eligible for upgrade you cannot do what you want to do. You have to complete the current contract before you can get a different phone at a reduced price. The only method you have is add another line to your plan and switch the phone, find a compatible phone on ebay or purchase a att gophone at the nromal price and swap the sim

I'm not sure what you mean because the new shared data plans have not started yet so it is not possible to have two phones on a data plan. Even if your two phones are on a shared family plan, that only shares minutes. Each phone must have its own data plan.

When you say set up a whole new plan, what do you mean? Do you mean that you have to change from the family plan that you have now, do you mean that you have to add a line or do you mean that you have to start another two-year contract?
If you meant start another two-year contract, you would have to do this if you wanted the phone for "free". In reality, there is no such thing as a free phone.
