Sold a Blackberry under false pretenses.

Hello,
I'm writing to ask for some sort of solution to rectify what I was sold.
Last year (August 2011), I intended to buy a Blackberry 9900. ATT staff informed me that ATT had no current plans to carry the 9900 and I settled for the 9810.
ATT now has the 9900, not too long after I bought the 9810. Honestly, I would like to swap out my 9810 for free and without further contract extension. Why? I have paid hundreds of dollars to ATT on a monthly basis for over five years, I am/was an ATT Uverse/DSL customer for a total of around three years, and I was sold the 9810 under false pretenses.
I have been jerked around by ATT customer support abotu a dozen times, so I am making this public in hopes that ATT will step up to the plate. I have given you thousands of dollars each year, let's see my patronage at work.

So, you're saying ATT is welcome to lie to me blatantly? Fantastic.
When I got my Torch, most other carriers had the 9900. It was only a matter of time til they got it too. It wasn't "we're not carrying it yet" or "I don't know when we'll have it", but "we do not plan on carrying the 9900".
What has my thousands of dollars per year bought me with ATT? You'd think they could... you know... try to satisfy a customer.
There was also the time when they shipped my upgrade from a couple years ago to the wrong address and told me "too bad, use your old phone" and refused to reset my upgrade so I could get a new phone. The more I think about it, the more it seems ATT doesn't want my money.

The did NOT KNOW that the device was coming to their venue - they are sales people and managers are not mind readers to know what is coming down the pipe line for sale, just becasue they could not answer your question at the time does not equate out to "false pretenses", just a honest answer based on the facts as they knew it at the time.
If they make a "exception" for you, it sets a precedence and everyone will want one, not going to happen. Want a new phone - pay retail, waitt until your upgrade eligibility date comes around or etf and go to another carrier - just be aware the other carriers follow the exact same policy, they don;t make exceptions either

You're doing what a lawyer (or law student) would term "assuming facts not in evidence". You are assuming that the front-line AT&T staff in the store where you purchased the 9810 knew that the 9900 would be coming out 3 months later. You are further assuming that they purposefully misled you in order to make their sale that day.
A quick Google search on "blackberry 9900 AT&T" shows you that it wasn't announed officially by AT&T until November 1st for a launch 5 days later. Chances are good that the sales staff found about it then.
So no, AT&T is not going to give you a free 9900 because you played the technology lottery and lost. Manufacturers and carriers release new phones all the time. If you wait around for every new device, you'll be waiting forever. If you knew the other carriers were coming out with the phone, then you should have waited.
You can wave the amount of money you spend and your tenure with AT&T around as justification for why AT&T should feed your sense of entitlement, but chances are there are people here who have been customers of the company longer and spend more money who understand that they signed a contract by which they have to abide.

I'm sorry that the 9900 came out after you'd already purchased the 9810. I understand you're frustrated but unfortunately, we don't get advanced notice on phone releases.
There was no way the staff who assisted you could have known about the 9900 being released.
