How do I get a phone that finally works?!?!? [ Edited ]

I have had 2 Motorola Atrix's replaced because they have frozen, bug fixes, and/ or sticking keys when on a call. I have tried (by myself and with AT&T and Motorola support) ways around the issues but ended having to send both of them for repair. The 3rd and (hopefully) final Atrix should arrive tomorrow from Motorola. This was after I had to pay to send it back to them. That was the last straw with Motorola. After about a week of emails, and 2+ hours on the phone with AT&T about my issues and displeasure with the Atrix, a rep from AT&T gave me a credit for not having my phone for 2 weeks.  I have been over and over on the phone with AT&T warranty exchange about me switching to another phone (PREFERABLY NOT A MOTOROLA) but I am bombarded with "Well, we can early upgrade you for $$$" I have been told that I have ONLY had 2 failed phones, and that a case (to see if they would even let me change to another phone) could not be done until at least 3 failed phones were under the belt. No one seems to care that I did not spend money on a new phone to have it fail. 2 strikes for me and that is it, I want out, try something else that would make me feel better about the money I spent on the new Atrix. One rep from AT&T told me that it is likely 99% percent that they won't allow an exchange to a different make and model. My 365 day warranty has expired. I do not want to "early upgrade", I don't want to cough up ANY MORE MONEY. Does anyone know who has the power to over ride these ridiculous restrictions?   I just want to move away from a phone manufacturer that has not worked out for me and get my original money's worth.

No one should override that as its against policy. I'd be talking to Motorola since they made the bum phone
