Restocking fee question

I just upgraded to a Samsung Infuse and the phone is great but doesn't have the feel of the HTC and I feel more comfortable with an HTC that has a little more thickness like the Vivid.   I just got this last Thursday 5/10 and have been told by ATt that I have up to 30 days to take it to an ATT store to do an exchange.   However, reading the policy I see that it could be a $35 restocking fee and was wondering if it would apply.  It really isn't clear.   The phone I want would be an increase in my cost (only $49), and would I need to do a new activation (another $36 fee)?

activation charge is one time, if you take advantage of the one time buyers remorse exahange you will not be charged it again. As far as rstocking fee - you can discuss it with the store you bought it at. You might get it waive, if you bought it from a franschise dealer that is up to them. If you bought the phone from a franchise dealer you have to take it back to the same dealer you bought it from.

If you ordered online there should be no restocking fee in a corporate store.  Don't know about a franchise dealer.  Never dealt with returning a phone to one of them.

Thanks.  That was what I was hoping.  It is a shame that the Samsung is so thin.  I really like it too.
