If you are talking about a new iPhone that is rumored to be coming out, it depends on when you are upgrade eligible.  If you got your 3GS as an upgreade through a commercial channel (AT&T or an authorized agent, best buy, amazon, etc), then no, you would not be eligible for an upgrade.  If you got it from an individual, then chech to see when you are upgrade eligible.

If you mean the new OS 4, then, from what I have read, the 3GS phone is upgradable  to the new OS4.

Aye I may need to splurge on ebay for the new phone. I was refering to the new device, the 4th generation iPhone. As you know apple will not release any information till they are ready but i remain confident it will be released this summer. They just waiting on the OS4.0. If you havent already, Beta 3 is pretty polished, :-)    I bought the phone about a month ago from apple so I dont think I will be upgrade eligible. Thats kinda weird that I cannot simply buy the new phone when I want. Bummer :-/

You can buy it whenever you want, but will have to pay retail for it....which is a bummer since you used your upgrade....I am eligible for an upgrade this Aug. 12th.  I am anguising over ver 4, or wait to see what the new phones using the new Microsoft OS looks like.....decisions, decisions...

How is it weird?  You just purchased a phone at a heavily discounted price in exchange for fulfilling a two-year contract.  Your contract will not be close to completed when (if) a new iPhone comes out.  Do you think you should be able to upgrade anytime you want?

When does the "early upgrade" path become available?  I used it back in February after only a year of service.  At $400, it wasn't too big a pill to swallow.

Really, even $600 isn't that much if you really enjoy it.

get a real phone.. Android!.. oh wait, we cant because ATT doesnt have any.

The Nexus One that works with AT&T 3G bands is available directly from Google.  {uncalled for comment edited}

Actually, AT&T does have 1 Android phone. It's the Motorola Backlfip.

A crippled Android, but an Android after all.

I am looking forward to the next iPhone.  My current 3G iPhone is starting to SHOW it's 2 years of hard usage.   While the device works as it on day one, the outside of it is a bit worn.  June can not come soon enough.

If that iPhone is really the next iPhone, I am really looking forward to it.  My 3G, is almost 2 years old and it's showing it.
