Connecting my fax gets me a busy signal

I recently got a new gateway, the old gateway worked fine with my HP All-in-one fax machine. When I hooked it up exactly the same with my new gateway, I am getting a busy signal.
I have the green data cord from my gateway phone line connection into a splitter into the wall jack. I have my fax line in the other side of the splitter. I get a bust signal on both my phones and my fax. If I disconnect the fax (either end; from my fax or from the splitter) my phones get a dial tone, but of course the fax is not connected.
I have read several posts which say this should work. I have also read posts which say I should try and connect the fax to an aux input on the gateway, but my gateway does not have one. the only other connection on the gateway which takes a phone plug is the "dsl" connection but I have VOIP.
Any suggestions?

There is some discussion over on uverse users about the cord between the fax and the line carrying two possible lines & these can somehow get crossed up in the fax machine. - http://www.uverseusers.com/index.php?option=com_sm
Don't know how you can be sure to have only one line connected unless you can open up your wall plate.
Doesn't your fax machine have a line jack and a tel jack? Can you remove the splitter - plug in the fax machine to the wall & plug the phone into the tel jack on the fax machine.

I would try putting the splitter on the back of the gateway in the phone 1 - 2 port, plug the line from the fax to one side of the splitter and plug your phone line into the other side, unless there is another problem it should work that way.
